Blossend Inc. ("Company," "we," "us," or "our") operates PabloDiazT.com and related platforms including OpenMyPro, Noizz.io, and Blossend.com. These Terms of Service ("Terms") govern your access to and use of our websites and services.
1. Acceptance
By accessing or using our websites or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services. PabloDiazT.com is a portfolio and informational website. Blossend Inc. also operates OpenMyPro (healthcare marketplace connecting patients with providers), Noizz.io, and Blossend.com. We provide these services "as is" and reserve the right to modify, suspend, or discontinue any service at any time without liability.
3. User Accounts
Where account registration is required (e.g., OpenMyPro, Noizz.io), you must provide accurate information and maintain the security of your credentials. You are responsible for all activity under your account. We may suspend or terminate accounts for violation of these Terms or for any other reason at our discretion.
4. Intellectual Property
All content, trademarks, logos, software, and materials on our sites and services are owned by Blossend Inc. or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. You retain ownership of content you submit, but grant us a license to use it to provide our services.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOSSEND INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. 6. Indemnification
You agree to indemnify, defend, and hold harmless Blossend Inc., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction therein.
8. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated via email or notice on our services. Your continued use after such changes constitutes acceptance. If you do not agree, you must stop using our services.
